COMMISSION ON PRE-JUDICIAL REGULATION OF THE DISPUTES BETWEEN INVESTORS EXECUTIVE AUTHORITIES AND LOCAL SELF-GOVERNING ORGANS

In performance of Cabinet of Ministers of Ukraine order from 12.08.03 to № 32285 to the Order of the President of Ukraine from 28.05.03 № 1-1/598, with the aim of appearing disputes between investors and executive authorities and local self-governing organs. For perfecting the region investment climate by the Head of Sevastopol city state administration's Order from 13.10.2003 № 1608-r there was created a constantly acting consulting-consultative organ - a commission on pre-judicial regulation of the disputes between investors executive authorities and local self-governing organs.

According to this Order there were confirmed following members of the Commission:

Larisa Glushakova - Head of juridicial unit of bodies

The activity of a Commission on pre-judicial regulation of the disputes between investors and executive authorities and local self-governing organs is regulated by corresponding Regulations. Project of given Regulations defines rights and obligations of Commission members, including non public serviceres, that is why at the present moment passes a co-ordination in Sevastopol city department of justice.  Approving of given Regulations by order of a Head of Sevastopol city state administrations is planned on January 2004.

Commission is created for the reason:

- regulation in pre-jidicial order of disputes between foreign investors (hereinafter investors) and executive authorities' and local self-governing organs;
- prevention of arising disputes between foreign investors (hereinafter investors) and executive authorities' and local self-governing organs;
- shaping the positive conditions for investment activity and perfecting investment climate in Sevastopol region.

Cardinal principles of Commission activity is:

- Legality;
- collegiality;
- complete consideration of given documents and other materials;
- substantiation of accepted decisions;
- independence of Comission members (impermission of interference in Commission activity of physical and juridical persons, executive authorities organs and local self-governing organs);
- competence of Comission members.

Primary tasks of Commission are:

1. Organization within the limits of their own authorities of work with the aim of preventing the arising disputes between investors and executive authorities'organs and local self-governing organs and their regulation in pre-judicial order.

2. Preparation and granting the offers to the Head of Sevastopol city state administration for preventing the arising disputes between investors and executive authorities'organs and local self-governing organs, determination of ways of their pre-judicial adjusting.

3. Consideration on the request of proposers - investors, executive authorities'organs and local self-governing organs of statement on arising the disputes and granting to sides - participants of a dispute of recomendation deciding for possible ways of its pre-judicial adjusting.

4. Participation in preparing the conclusions for projects of laws, other acts of legislation on questions of improvement of acting legislation on questions of preventing an arising disputes between investors and executive authorities'organs and local self-governing organs, their pre-judicial regulation.

5. Realization of operative information exchange with Ukrainian and foreign managing subjects and organs an authorities comparatively entrusted on it problems.

6. With the consent of sides - participants of a dispute, to place the materials of consideration of statements and accepted recomendation descisions in domestic and foreign mass media.
